Beta Terms of Use

Section 1 Scope of Application

These Beta Terms of Use apply in addition to, and take precedence over, the full General Terms and Conditions (AGB) for the use of Anvio during the current closed beta phase. For everything not governed differently here, the full General Terms and Conditions apply accordingly (in particular scope of application/B2B-only, permitted use, liability, confidentiality, final provisions). Please note: the full General Terms and Conditions are available exclusively in German, and the German version is authoritative.

Section 2 Free Beta Access

During the beta phase, access to Anvio is granted exclusively via an individually issued beta access code. Use is entirely free of charge for the duration of the beta phase; there is no payment obligation. No automatic conversion into a paid subscription takes place.

Section 3 Beta Status — No Guarantee of Availability or Functionality

As beta software, Anvio is under active development. You expressly acknowledge:

• Features may change, be discontinued, or be temporarily unavailable at any time.
• There is no guarantee of availability and no assurance of any particular uptime.
• Data loss, malfunctions, or unannounced interruptions are possible during the beta phase; any productive, business-critical use is at your own risk.

The liability of Agile Forge for intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit), as well as under the provisions of the Produkthaftungsgesetz (German Product Liability Act) and for injury to life, body, or health, remains unaffected by the foregoing.

These beta terms apply to the free, individually granted beta access (Section 2). For users with a paid Pro or Team subscription, the full General Terms and Conditions (AGB, German only) apply instead, including the warranty and liability provisions contained therein; the beta-specific exclusions of liability set out above do not limit the rights of paying customers.

Section 4 Termination of Beta Access

Agile Forge may terminate beta access at any time with reasonable notice, in particular upon conclusion of the beta phase or upon transition to regular, paid commercial operation. Extraordinary termination in the event of serious violations of the usage rules of the full General Terms and Conditions remains unaffected.

Section 5 Transition to a Regular, Paid Subscription

The transition from free beta access to a regular, paid subscription (Pro/Team) does not occur automatically. It requires separate, active consent to the full General Terms and Conditions (AGB, German only), including the pricing, payment, and cancellation provisions contained therein.
